You will be asked questions related to your complaint/claims to establish elements necessary for each charge. These are called "prima facie" (or “at first view”) elements. Each element must be established for each charge to arrive at a “For Cause” finding on each alleged harm.
For Fair Housing Investigations, the investigator will also ask if you're interested in conciliation throughout the investigative process.
The burden of proof is on the Complainant, which means you will have to provide the evidence to support your claims of discrimination.
The “prima facie” elements are established by the U.S. Supreme Court, The 5th Circuit Court of Appeals, and the Texas Supreme Court.
